Progress Not Perfection LLC (“Company”, “we”, “us”, “our”) is dedicated to protecting your privacy. This privacy policy (“Privacy Policy”) outlines our ongoing obligations to you in respect to how we manage your information. It also describes what information we may collect, use, store, process, disclose, secure and share about you when you access our website at http://www.laurendrain.com (the “Site”) and/or use any of our services, including but not limited to our content, products, services, software, technology, promotions, and any other material that we may provide (together with the Site, collectively, the “Services”).  This Privacy Policy also describes how you can control, correct and/or update such information. 

By accessing or using our Services, you expressly agree and consent to our collection, use, storage, and disclosure of the information that you provide us as described in this Privacy Policy. This Privacy Policy is incorporated by reference into our Terms of Service available at http://www.laurendrain.com/terms-conditions (“Terms of Service”) and is subject to the provisions of the Terms of Service.  Capitalized terms used in this Privacy Policy but not defined herein shall have the same meaning ascribed to such terms in our Terms of Service.

  1. Data We Collect.  We may collect information that can identify you as an individual, including, for example, your first and last name, address, telephone number, and e-mail address, as well as any other non-public information about you that is associated with or linked to any of the foregoing information (“Personal Information”), and other information as described in this Privacy Policy. 
  2. How We Collect Data.
    1. You Provide Us with Information.
      1. We will collect your first and last name, e-mail address, address, and password that you provide when you create an account to log in to our Services (“Member Account”). We may also collect your shipping and billing address, date of birth, and payment information, or any other information if you decide to provide us such information. 
      2. We may also collect your photograph(s) and/or profile picture in the event you decide to provide such photograph(s) and/or profile picture to us.
      3. When you send messages to us or other members of the Services, or post public messages on our blogs, the recipient of such messages will be able to see your name and profile photo along with the content of your messages. 
      4. If you provide us feedback or contact us via e-mail, phone call, text message, or other means of communication, we will collect your name, e-mail address, and phone number (as applicable) as well as any other content included your communication to us, in order to reply to you.
    2. Information Collected Automatically via Technology.
      1. Information Collected by Servers.  To make our Services more useful to you, our servers (which may be hosted by a third-party service provider) may collect and store certain usage related information regarding your computer or device, including, but not limited to:
        • The date and time of your visit and the web pages, content, and links you click on while navigating our Services;
        • Information about the type of content accessed via our Services;
        • The website(s) you visited before and after visiting our Site;
        • Your Internet Protocol (IP) address; 
        • Information about your device such as your device type, browser type, screen size, language and other settings, memory capacity, plug-ins, Internet domain, advertising identifiers, TCP configuration parameters, operating system, carrier code, time zone and the names, versions and package IDs of software installed on your device; and
        • Information collected through Cookies and other tracking technologies (see below). 
      2. Cookies.  Like many websites, our Site, as well as certain third-parties that provide content and other functionality on our Site, use Cookies to collect information. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which remain on your computer until you delete them) to provide you with a more personalized and interactive experience on our Services.
      3. Web Beacons. We may also use web beacons, including “Facebook pixels”, to count the number of visitors to a particular web page, to deliver or communicate with cookies, and to understand usage patterns. We also may include web beacons in e-mails to understand whether messages have been opened, acted on, or forwarded.
      4. Other Technologies.  There are other local storage and Internet technologies, such as “Flash Cookies” and HTML5 local storage that are stored on your device and can be used to store certain information about your usage activities and preferences across different services and sessions.  Please note that these technologies are distinct from cookies, and you may not be able to control them using the standard browser tools and settings.       5. Analytics Services.  We use third-party analytics services (“Analytics Services”), including but not limited to Google Analytics and Facebook Analytics, to help analyze how you use our Services. The information generated by the Cookies or other technologies about your use of our Services (the “Analytics Information”) is transmitted to the Analytics Services. The Analytics Services use Analytics Information to compile reports on your activity. The Analytics Services may also transfer the Analytics Information to third-parties where required to do so by law, or where such third-parties process Analytics Information on their behalf. Each Analytics Service’s ability to use and share Analytics Information is governed by such Analytics Service’s terms of use and privacy policy, which may be more or less restrictive than our Terms of Service and Privacy Policy. By using our Services, you consent to the collection, use, sharing, storing, and processing of data about you by Analytics Services in the manner and for the purposes set out above.
  3. How We Use Your Personal Information.
    1. General Use.  The Personal Information we collect is used for the primary purpose of providing our Services to you, to respond and fulfill the requests you make, and/or improve our Services. We may also use your Personal Information in other secondary ways, including, but not limited to:
      1. facilitate the creation of and securing your Member Account on our Services; 
      2. identify you as a member in our Services;
      3. process and fulfill your requests to purchase items and programs through our Services;
      4. provide our Services;
      5. assist you with your health and fitness goals, such as providing you with advice and feedback on your goals and progress; 
      6. provide improved administration of our Services;
      7. measure and analyze audience traffic and improve the quality of your experience when you interact with our Services;
      8. send you email communication, including but not limited to: welcome e-mail; administrative e-mail notifications, (i.e. updates, security, or support and maintenance advisories); and promotional/advertisement emails for our Services, related products and/or services, or other third-party products and/or services;  
      9. prevent potentially prohibited or illegal activities, comply with applicable law, and enforce our Terms of Service; and
      10. carry out other purposes as permitted by law.
    2. Disclosure of Your Personal Information.  Except as described in this Privacy Policy, we will not disclose your Personal Information that we collect through our Services to third-parties without your consent. We may disclose your Personal Information to third-parties if you consent to us doing so, as well as in the following circumstances:
      1. Public Posts.  Some features on our Services may allow you to upload, post, or otherwise transmit content to public areas of the Services, such as content that you post in a public profile associated with your Member Account, or blog entries on the Services. Any content you post to public areas of the Services is available for public viewing. Once displayed on publicly viewable areas of our Services, your content can be collected and used by others. We cannot control who reads your postings or what others may do with the content that you voluntarily post, so it is important that you do not include in your posts Personal Information that you do not wish to make public. Once you have posted information publicly, you will not be able to edit or delete such information after it has been cached, collected, and stored elsewhere by others.
      2. Third-Party Service Providers.  We may share your Personal Information with third-party service providers to perform business functions on our behalf to better serve you. For example, we use third-parties to provide technical support, process credit card payments and/or provide other services to Company, including but not limited to the Analytics Services. These third-parties only have access to your Personal Information as necessary to perform their functions and may not use it for any other purpose.
      3. Business Transfers.  We may choose to buy or sell assets. In these types of transactions, user information may be one of the business assets that are transferred. As such, information about you, including Personal Information, may be disclosed and otherwise transferred to an acquirer, successor or assignee as part of any merger, acquisition, debt financing, sale of company assets, or similar transaction, as well as in the event of an insolvency, bankruptcy, or receivership in which Personal Information is transferred to one or more third-parties as one of our business assets. You acknowledge that such transfers may occur, and that any acquirer, successor or assignee may continue to use your Personal Information.
      4. Other Disclosures.  Regardless of any choices you make regarding your Personal Information (as described below), Company may disclose Personal Information if Company believes in good faith that such disclosure is appropriate: (i) in connection with any legal investigation or proceeding; (ii) to comply with applicable laws or to respond to subpoenas or warrants served on Company; (iii) to exercise, protect, or defend the rights or property of Company, its affiliates or its members of the Services; (iv) to investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy, our Terms of Service or any other contractual arrangement; (v) to enforce our Terms of Service; and/or (vi) take precautions against liability, to investigate and defend ourselves against any third-party claims or allegations, to assist government enforcement agencies, or to protect the security or integrity of our Site or Services.
  4. Security of Your Personal Information. We will store your Personal Information in accordance with applicable law and in a manner that reasonably protects it from misuse, loss, and/or unauthorized access, modification, or disclosure. 
  5. Conditions of Use. If you decide to use or otherwise access our Site or Services, your use/access and any possible dispute regarding privacy is subject to this Privacy Policy and our Terms of Service, including limitation on damages, arbitration, and application of Nevada state law.
  6. Third-Party Websites and Applications.  Our Services may contain links to third-party websites and applications. When you click on a link to any other website or application, you will leave our Services and go to a third-party website or application where such third party may collect your Personal Information. We have no control over, do not review, and are not responsible for, these third-party websites, applications, or their content. Please note that the terms of this Privacy Policy do not apply to such third-party websites and applications, or to any collection of your Personal Information after you click on links to such third-party websites or applications. By visiting a third-party website or application, you may be subject to such third-party’s terms of service and/or privacy policy, which may be more  or less restrictive than our Terms of Service or Privacy Policy. We encourage you to read the privacy policies of every website you visit and application you use. Links to third-party websites or applications provided in our Services are provided for your convenience. 
  7. Your Choices Regarding Your Information.  You have several choices regarding the use of your information on our Services:
    1. E-mail Communications. If we send an e-mail to you, you may unsubscribe at any time by following the instructions contained within the e-mail. Additionally, we may allow you to view and modify settings relating to the nature and frequency of promotional communications that you receive from us by following the instructions contained within the email sent to you. Please be aware that even after you opt-out from receiving e-mails or messages from us, we may continue to send you account or service-related communications, including notices of any updates to our Terms of Service and/or Privacy Policy.
    2. Cookies.  If you no longer wish to accept Cookies for any of the purposes described above, then you can instruct your browser, by changing its settings, to stop accepting Cookies or to prompt you before accepting a Cookie from the websites you visit. Consult your browser’s technical information. However, do note that you may not be able to use all of the functionalities of the Services if you modify your browser settings to not accept Cookies.
    3. Google Analytics.  You may prevent your data from being collected and used by Google Analytics by opting out through the use of the Google Analytics Opt-out Browser Add-on available at https://tools.google.com/dlpage/gaoptout/.
    4. Accessing, Changing or Deleting Your Personal Information.  You may access, update and/or correct your Personal Information by signing into your Member Account on our Site, clicking on the “My Account” page, and then clicking on the “Edit Account” tab. You may request deletion of your Personal Information by us, and we will use commercially reasonable efforts to honor your request, but please note that we may be required to keep such information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). Please note that some information may remain in our archives for our records or as otherwise required by law. We may also retain your information for fraud prevention or similar purposes.
  8. Do Not Track.  We currently do not respond to “do not track” signals. 
  9. Your California Privacy Rights.  Pursuant to California Civil Code Section 1798.83, California residents that have provided us Personal Information have the right to receive: (a) information identifying all third-parties to whom we may have disclosed (within the previous calendar year) your Personal Information for that third-party’s direct marketing purposes; and (b) a description of the categories of Personal Information disclosed. California residents that wish to receive such information may e-mail a request to Privacy with “Request for California Privacy Information” as the subject line of your e-mail.  Please note that not all information sharing is covered by the requirements of California Civil Code section 1798.83 and only information covered within this statute will be included in our response. Also, please note that under California law, we are only required to respond to one request per California customer during any one calendar year.
  10. Our Policy Towards Children.  The Services are not intended for or directed to persons under the age of 13, and we do not intentionally collect information from such persons. If we discover that a child under the age of 13 has submitted Personal Information to us, we will attempt to delete the information as soon as possible.   11. Maintaining the Quality and Accuracy of Your Personal Information. It is important that your Personal Information is accurate and up to date. Please update or correct such Personal Information if you find that your Personal Information is inaccurate or not up to date. Having accurate and update Personal Information allows us to continue to provide quality services to you.

Changes to This Privacy Policy.  This Privacy Policy may be revised at any time for any reason.  We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy at www.laurendrain.com/privacy-policy/ and we will change the “Effective Date” above to indicate when those changes were made.  You should consult this Privacy Policy regularly for any changes. Your continued use of our Services after such changes constitutes your acceptance of such changes and will be subject to the then-current privacy policy.
